The Payday Jet Setter: Billy Webster of Advance America

Billy Webster (William M. Webster, IV) co-founded Advance America in 1997. Under his leadership, the company grew from 300 stores to over 2,000 stores, making it the largest payday lender in the country at one point. He recently served as the CEO and Chairman of the Board of the company.

Webster is not only a payday lending executive, he is a Washington insider and lobbyist. Prior to founding the company, Webster worked in the White House. He has credited his work in Washington with helping him launch his payday lending company because it gave him connections on Wall Street. From 2009 to 2010, Webster was a registered federal lobbyist on behalf of Advance America. He founded the Washington lobbying arm and trade association for the payday lending industry and served as the group’s president prior to 2002. He has been an active campaign contributor and the company’s private jet has been used by politicians to raise money.

In 2010, Advance America and Webster agreed to pay a $18.75 million to settle a class action lawsuit over the high interest rates that the company charged its customers. So, it’s no surprise that Webster opposed capping the interest rates that payday lenders can offer.

In 2004 alone, Webster earned $20.2 million, 98 percent of which was from selling his stock in Advance America filing the company’s IPO. He has made hundreds of thousands of dollars working for the company since selling his stock. He and his family have also used the company’s jet for personal reasons for years according to corporate filings.

Over the years, Webster has contributed $778,393 to the campaigns of powerful politicians and special interest PACs.

Webster Contributed to Many Campaigns While His Company’s Jet Was Used by Political Committees

  • Webster Contributed Money To Many Campaigns And The DGA Used Advance America’s Corporate Jet For Events. “Advance America, the nation’s largest payday loan company, which operates at least 10 offices in New Mexico, loaned its jet to the DGA for at least seven trips in 2005 and 2006. These trips had a total reported value of nearly $20,000. The company, which was fighting tougher payday loan restrictions in this state, also donated $10,000 to the DGA last year and $1,750 to Richardson’s re-election. This year, William Webster, chief executive officer of Advance America, donated $4,600 to Richardson’s presidential campaign, the maximum amount allowed by federal law. (Individuals are allowed to contribute a maximum of $2,300 for use in the presidential primary season and $2,300 for use in the general election.) Webster Contributed to Campaign That Tried to Hide His Identity As a Payday Lender

  • North Carolina Lawmaker Called For Investigation Into Campaign Contribution That Webster Gave That Concealed His Employer, Claimed He Was A “Manager” In The “Printing Industry.” “A critic of House Speaker Jim Black asked the State Board of Elections on Monday to investigate more than $60,000 in contributions from payday loan company executives, arguing that their industry connections are being obscured in campaign finance reports. The complaint filed by Jim Sinsheimer, who has been leading an effort to get Black to resign as speaker, cites donations made to 38 committees of current or former lawmakers from both parties since 2003. In many cases, Sinsheimer told reporters at a news conference, the contributors’ addresses or professions have been wrongly reported or were incomplete. Campaigns are supposed to make their ‘best efforts’ to identify the contributors’ job title or profession. Several of the mislabeled contributors are heads of publicly traded companies, he said, leading to questions about whether legislators have deliberately filed false reports. Payday lenders attempted through state legislation or out-of-state banks to keep offering the short-term, low-dollar loans after the law that regulated the industry expired in 2001. Attorney General Roy Cooper got the remaining outlets to shutter their doors earlier this year, but consumer advocates are worried out-of-state companies want to get a new law passed to revive the loans. ‘It’s not too difficult to ask them to accurately fill out campaign finance reports because it’s the only way we can see who is attempting to influence legislation and who’s supporting our political candidates,’ Sinsheimer said at a news conference. ‘When you see this kind of noncompliance … something is amiss. And that’s what I’m trying to point out to the State Board of Elections.’ In many cases, Sinsheimer cited campaign reports in which the profession of the donor was wrong or vague, or the person’s address was actually that of an industry lobbyists. Sinsheimer also has created a Web site designed to push for Black’s removal as speaker. In one case, the campaign of Rep. Earl Jones, D-Guilford, received $1,000 from a William Webster of Spartanburg, S.C. His profession is listed as ‘manager, printing industry.’ But William Webster also is the name of the chief executive officer of Advance America, the nation’s largest payday loan company.” [AP, 5/22/06]

Advance America and Webster Had to Pay $18.75 Million to Settle Suit Over the High Interest Rates the Company Charged

  • In 2010, Advance America Paid $18.8 Million To Settle A Class-Action Lawsuit Brought By Consumers Who Said It Had Charged Illegally High Interest Rates. “In March, McAuliffe received a combined $15,000 in donations from William M. Webster IV and Lindsay Webster.   • Advance Cash America And Co-Defendant William Webster Agreed To Pay $18.75 Million To Settle Class Action Lawsuit In North Carolina. “Advance America Cash Advance Centers Inc., its North Carolina subsidiary and co-defendant William Webster IV on Sept. 17 agreed to pay $18.75 million to settle a class action lawsuit in North Carolina according to a Form 8-K filed Sept. 20. The agreement, which is still subject to court approval, will set up a settlement pool to be funded in three payments. Advance America will pay $7.5 million after preliminary court approval, expected before Sept. 30; $8 million on March 1, 2011; and $3.25 million on the first business day of 2012. The company expects to take a charge against earnings in the third quarter for the settlement of between $16.25 million and $18.75 million, depending on the amount of insurance proceeds. So It’s No Surprise That Webster Opposed Capping Interest Rates on Payday Loans

  • Webster Opposed Capping Payday Lending Rates At 36 Percent, Claimed It Would Kill The Industry: “Abusive Is Not A Defined Term And What Is Abusive To Somebody May Not Be Abusive To Somebody Else.” “Warren, who could become the agency’s first director, has also raised concerns about payday loans. In written testimony to the House Financial Services Committee in 2009, Warren highlighted a survey that found that payday loan customers are aware of finance charges but often unaware of annual percentage rates. And in her 2008 ‘Making Credit Safer’ article in Harvard Magazine, Warren accused a lender of trying to hide a 485.450% interest rate. Many consumer advocates argue that payday loan interest rates should be capped at 36%, just as they are for military families. But Webster says such a move would kill the industry. ‘A 36% rate, and the consumer advocates know this, is not regulation; it’s prohibition,’ he said. In addition, Webster argued that payday loans are not aimed at trapping consumers. ‘That’s just unequivocally wrong,’ said Webster. ‘We disclose to the consumer at the point of sale and on their financial contract that if they can’t pay us back in two weeks, they have a unilateral right to modification.’ It’s unclear how the consumer bureau, set to launch on July 21 as a new financial markets cop, will address payday loans. The agency cannot cap rates as many states are doing, but it does have authority to prevent ‘abusive’ financial practices, a power that is somewhat concerning to Webster. ‘Abusive is not a defined term and what is abusive to somebody may not be abusive to somebody else. Theoretically, anybody would be concerned about that as a benchmark,’ he said. ‘But having said that, if all financial products…are all evaluated based on the same criteria, we think it would give definition to what abusive really is.’” [Wall Street Journal, 5/13/10]
    • Webster Supported Elizabeth Warren To Head The Consumer Financial Protection Bureau. “Consumer groups have long criticized payday loans, and are expecting the new U.S. consumer watchdog agency to crack down on the expensive products they believe suck struggling consumers into dangerous debt traps. But at least one payday loan industry executive says he’s ready for new U.S. federal scrutiny and he’s hopeful his company will thrive under the new regime. In an interview this week, Advance America Cash Advance Centers, Inc. (AEA) Chairman William Webster said he thinks his company stands to benefit from the Consumer Financial Protection Bureau, which Congress created last summer to write and enforce consumer protection laws and root out fraudulent financial practices. Although the financial industry largely opposed the creation of the new consumer bureau, Webster had positive things to say about the agency and its chief architect, Elizabeth Warren, whom the president could tap to spearhead it. ‘Thus far, from what we’ve heard from professor Warren, she’s focused on issues we think are critical–transparency, disclosure, fairness, making sure customers can compare products in a simple way and also treating similar banking products similarly,’ he said.” [Wall Street Journal, 5/13/10]
